1. Ownership — all rights reserved
All sound recordings, musical compositions, lyrics, melodies, vocal performances, instrumental performances, cover art, photography, videos, liner notes, metadata, written content, software, logos, and brand elements made available on this Service are the exclusive property of J. Michaels and/or J. Michaels Music, or are used under license. They are protected by United States copyright law (Title 17 of the U.S. Code), the Berne Convention, the WIPO Copyright Treaty, and international copyright treaties. © J. Michaels Music. The artist J. Michaels owns and reserves all rights in his work, including but not limited to: master sound-recording rights, publishing and composition rights, mechanical rights, performance rights, synchronization rights, neighboring rights, and moral rights to be identified as the author and to object to derogatory treatment of the work.
2. What a purchase grants you
Buying a song grants you a limited, personal, non-exclusive, non-transferable, revocable license to download and play that song for your own private, non-commercial listening. No other rights are transferred. Specifically, a purchase does not grant master, publishing, performance, mechanical, synchronization, broadcast, derivative-work, sampling, lyric-reprint, public-display, or any commercial-exploitation rights.
3. Prohibited uses — strictly forbidden without prior written consent
Without prior written consent from J. Michaels, you may NOT:
- Copy, reproduce, redistribute, re-upload, mirror, host, share, stream, broadcast, podcast, or publicly perform any recording or composition;
- Sample, remix, mash up, loop, slow down, speed up, pitch-shift, edit, or otherwise create derivative works;
- Synchronize any audio, video, or lyrics with film, television, advertising, social-media video, video games, or any other audiovisual work (no "sync" use);
- Reproduce, distribute, post, translate, or display lyrics in any form, including websites, lyric apps, social media, tattoos sold commercially, or merchandise;
- Perform cover versions, karaoke versions, instrumental versions, or live performances for commercial release, paid streaming, or monetized video;
- Mint, sell, or distribute any NFT, blockchain token, or other digital collectible based on the music, lyrics, or art;
- Use any recording, composition, lyric, voice, melody, or artwork to train, fine-tune, evaluate, or generate output from any artificial-intelligence or machine-learning model, including but not limited to text-to-music, voice-cloning, lyric-generation, and song-cover models;
- Scrape, crawl, bulk-download, or otherwise systematically extract content from the Service;
- Remove, alter, or obscure any copyright notice, trademark, watermark, or other proprietary marking.
4. Anti-theft & enforcement
Reproducing the lyrics, melodies, instrumental tracks, or sound recordings of J. Michaels — in whole or in part — without consent is copyright infringement. J. Michaels Music actively monitors for unauthorized use and will pursue every available remedy, including:
- Statutory damages of up to $30,000 per work infringed, and up to $150,000 per work for willful infringement, under 17 U.S.C. §504(c);
- Actual damages and disgorgement of the infringer's profits;
- Injunctive relief and impoundment of infringing copies (17 U.S.C. §§502–503);
- Recovery of costs and reasonable attorneys' fees (17 U.S.C. §505);
- Criminal referral for willful commercial infringement (17 U.S.C. §506, 18 U.S.C. §2319);
- DMCA takedown notices, content-ID claims, platform reports, and PRO/CMO enforcement.
Circumventing any technological protection measure (preview limits, signed URLs, watermarking, DRM) violates 17 U.S.C. §1201 and carries separate civil and criminal penalties.
5. Trademarks
"J. Michaels", "J. Michaels Music", the J. Michaels logo, and related artwork are trademarks of J. Michaels Music. You may not use them without prior written consent in any way that suggests affiliation, sponsorship, or endorsement.
6. DMCA — designated agent & takedown procedure
If you believe content on the Service infringes your copyright, send a written notice to our designated DMCA agent that includes all six elements required by 17 U.S.C. §512(c)(3):
- A physical or electronic signature of the owner or authorized agent;
- Identification of the copyrighted work claimed to be infringed;
- Identification of the allegedly infringing material and its location (URL);
- Your contact information (address, phone, email);
- A statement that you have a good-faith belief the use is not authorized;
- A statement, under penalty of perjury, that the information is accurate and you are authorized to act on the owner's behalf.
Counter-notices may be submitted under 17 U.S.C. §512(g). We maintain a repeat-infringer policy and will terminate accounts of users who repeatedly infringe.
