These Terms of Service ("Terms") govern your access to and use of the J. Michaels Music website, store, streaming, and related services (the "Service"), operated by J. Michaels Music ("we", "us", "our"). By accessing the Service, creating an account, or purchasing music, you agree to be bound by these Terms.

1. Accounts

You must provide accurate information when creating an account and are responsible for keeping your credentials secure. You may not impersonate any person, share your account with others, or use the Service if you are under 13 years of age.

2. Acceptable use

You agree not to:

Copy, redistribute, sell, sublicense, or publicly perform any audio, lyrics, cover art, or other content obtained from the Service;
Circumvent any access controls, DRM, watermarking, rate limits, or preview-length restrictions;
Scrape, crawl, or harvest data outside of our public RSS feed and sitemap;
Use the Service to train, fine-tune, evaluate, or otherwise feed any machine-learning model, including generative-AI systems;
Upload viruses, attempt to gain unauthorized access, or interfere with the Service.

3. Purchases & refunds

All purchases are digital goods delivered electronically and are final and non-refundable once the song is delivered to your library, unless required by applicable law. Prices are shown in U.S. dollars and exclude any tax we are required to collect, which will be added at checkout.

4. License granted to you

A paid purchase grants you a limited, non-exclusive, non-transferable, revocable license to listen to and download the song for your personal, non-commercial use only. All other rights are reserved. See our Copyright & Anti-Piracy Notice for full details on what is and is not permitted.

5. Termination

We may suspend or terminate your account at any time for breach of these Terms, suspected fraud, chargeback abuse, or unlawful activity. You may close your account at any time by contacting us. Sections on copyright, disclaimers, liability, indemnity, and dispute resolution survive termination.

6. Disclaimers

The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

7. Limitation of liability

To the maximum extent permitted by law, J. Michaels Music will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our aggregate liability for any claim arising out of or related to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $50.

8. Indemnification

You agree to defend, indemnify, and hold harmless J. Michaels Music from any claims, damages, liabilities, costs, and fees (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party right.

9. Governing law & dispute resolution

These Terms are governed by the laws of the United States and the State of residence of J. Michaels Music, without regard to conflict-of-laws principles. Any dispute will be resolved by binding individual arbitration; you waive any right to a jury trial or to participate in a class action. You may opt out of arbitration within 30 days of accepting these Terms by emailing the address below.
